Pursuant to Article 13 of the EU Regulation 679/2016 (hereinafter referred to as GDPR) on the protection of personal data, Simoni Srl informs you that the personal data collected, with reference to the contractual relations established or to simple requests for information, will be processed in compliance with the aforementioned regulation.

In relation to the aforementioned processing, Simoni Srl also provides the following information:

2. PURPOSE OF PROCESSING

The purposes of the processing of personal data are as follows:
1) fulfillment of legal obligations related to the contractual relationship;
2) organizational management of the contractual relationship;
3) satisfy the request received;
Personal data will be processed in paper, computerized and telematic form, and inserted in the relevant databases which can only be accessed by the owner and his agents. As regards the data processed electronically, it is emphasized that all appropriate security measures have been adopted to protect the rights, freedoms and legitimate interests of the data subject as per article 22.3 of the GDPR.

The personal data collected, with your free and express consent, are inherent to:

– identification data (e.g. name, surname, address, telephone, fax, e-mail, etc.)
– fiscal data (if required by law – for example tax code, VAT number etc …)

 

6. OBLIGATION TO PROVIDE DATA

 

The provision of data and the related processing are mandatory in relation to the purposes relating to tax obligations; it follows that any refusal to provide data for these purposes may make it impossible for the data controller to carry out the same professional relationships and legal obligations. The provision of data and the related processing is to be considered optional in other cases, without any consequence.

The provision of data is optional. Failing this, statistical data will not be analysed.

The provision of data is mandatory and implicit in the use of web protocols. Without it, it will not be possible to operate the site.

In relation to the purposes indicated in points 1, 2 and 3 of paragraph ‘2. Purposes of the processing’, the data may be communicated to the following parties or categories of parties indicated below:

  • Studi di avvocati riconosciuti relativi alla professione di assistenza alle aziende quando la comunicazione è dovuta per legge, regolarmente incaricati a tale forma di trattamento nel pieno rispetto delle misure vigenti, o quando la comunicazione è nell’interesse del soggetto.

7.1 Authorised for processing

To the extent relevant to the aforementioned processing purposes, the data may be disclosed to internal staff expressly authorised and instructed to process the data.

To the extent pertinent to the aforementioned processing purposes, the data may be communicated to providers of services functional to the processing, designated as Data Processors and consistently instructed, such as for instance:

  • the IT support service provider,
  • the web agency service provider.

The data may be communicated to public authorities in accordance with applicable legislation.

 

8. DISSEMINATION AND TRANSFER OF DATA

 

8.1 Data Dissemination

This will not be done.

 

8.2 Transfer to third countries

It will not be done by Simoni Srl. However, it remains possible that social networking platforms that provide content to the site (e.g. Facebook, YouTube) transfer data to the United States. Please refer to the privacy policies of the latter, available on their respective platforms.

 

8.3 Transfer to international organisations

This will not be done.

 

9. INTERACTIONS WITH SOCIAL NETWORKS AND EXTERNAL PLATFORMS

 

9.1 Social plug-ins

This type of tool enables interactions with social networks, or other external platforms, directly from the pages of this website (e.g. the button with the Facebook symbol).

 

9.2 Data Transmission

When you visit a page on our site and interact with the plug-in (e.g. by clicking the Facebook symbol) or decide to watch a video, the corresponding information is transmitted from your browser directly to the social networking platform and stored there.

 

9.3 Informations and rights

For information on the purposes, type and manner of collection, processing, use and storage of personal data by the social networking platform, as well as on how to exercise your rights, please consult the privacy policy adopted by the individual social network or other external platform.

 

10. RIGHTS OF DATA SUBJECT TO THE PROCESSING OF PERSONAL DATA

 

10.1 Right of access(Art. 15 GDPR)

You may request confirmation as to whether or not data relating to you is being processed, as well as further clarification of the information set out in this notice, and to receive the data itself, unless the return would infringe the rights and freedoms of others.

 

10.2 Right of rectification(Art. 16 GDPR)

You may ask us to rectify or supplement the data you have provided or otherwise in our possession if they are inaccurate.

 

10.3 Right of cancellation (Art. 17 GDPR)

You may request that the data acquired or processed be deleted.

 

10.4 Right of restriction (Art. 18 G.P.R.)

You may request the restriction of the processing of personal data; in that case, the data will not be processed, except for storage, without your consent, except as explicitly stated in the same Article in Section 2.

 

10.5 Right of portability (Art. 20 GDPR)

You may request to receive the data, or to have them transmitted to another named data controller, in a structured, commonly used and machine-readable format.

 

10.6 Right of objection(Art. 21 G.P.R.)

You may object at any time to the processing of your data on the basis of a legitimate interest, unless there are legitimate grounds for processing which override your rights, for example for the exercise or defence of our rights in court; the objection will always override our legitimate interest in processing the data for marketing purposes.

 

10.7 Right not to be subject to automated decision-making (Art. 22 GDPR)

You may request not to be subject to an automated decision-making process or even one based on profiling.

 

11. COMPLAINTS TO THE SUPERVISORY AUTHORITY

You may lodge a complaint with the supervisory authority of the Member State where he/she habitually resides, works or where the alleged infringement occurred.
